Investigation and trial of judges: September 2018

Recently, news about reveal of bribing judges has become more frequent in the media. In September 2018, the National Anti-Corruption Bureau of Ukraine, under the procedural guidance of the Specialized Anti-Corruption Prosecutor’s Office, made two indictments to the court regarding judges.

Such information was received from the National Anti-Corruption Bureau of Ukraine in response to our request.

These judges appeared to be Igor Minaiev, the judge of the Sloviansk City Regional Court of Donetsk oblast and Oleksandr Lysiuk, the former chairman of Baryshiv Regional Court of Kyiv oblast. The National Anti-Corruption Bureau of Ukraine accused both judges in obtaining unlawful benefits.

In particular, according to the investigation, judge Igor Minaiev allegedly received an illegal benefit in the amount of 6 thousand hryvnias for the promise not to bring to the responsibility for driving a car in a drunken state.

At the same time, another judge, Oleksandr Lysiuk, the former chairman of the Baryshiv Regional Court of the Kyiv oblast, is suspected by the detectives of the National Anti-Corruption Bureau of Ukraine that he allegedly received 2.5 thousand US dollars in exchange for a decision in a civil case to secure a claim.

As of the date of publication, the judge are not detained and continue to conduct legal proceedings, despite the existence of criminal proceedings against them.

However, in September, the Supreme Council of Justice passed three decisions on the temporary removal of judges in connection with the prosecution. The petition for their temporary removal was also filed by the Specialized Anti-Corruption Prosecutor’s Office.

In particular, in September, the Supreme Council of Justice temporarily withdrew:

Khytruk Volodymyr, acting Head of the Barsky Regional Court of the Vinnytsya oblast, who is suspected of obtaining an unlawful benefit for a judge’s decision to close the case regarding an administrative offense;

Ponomarenko Volodymyr the judge of the Court of Appeal of the Cherkasy oblast, who, according to law enforcement officers, allegedly demanded and received money from a local citizen to influence the judges of one of the regional courts of Cherkasy oblast;

Necheporenko Leonid, Judge of the Rokitnya Regional Court of the Kyiv oblast, whom the National Anti-Corruption Bureau of Ukraine suspects in obtaining unlawful benefit for not bringing a citizen to the administrative liability.
